Lacey Act Declaration to be required for additional products beginning December 1, 2024

The United States Department of Agriculture (USDA) Animal and Plant Health Inspection Service (APHIS) recently issued a Federal Register Notice (FRN) indicating that Phase VII of the Lacey Act enforcement schedule is expected to begin on December 1, 2024.

According to APHIS, this next Phase of Lacey Act will require a Lacey Act Declaration (PPQ 505) for “all remaining plant product Harmonized Tariff Schedule (HTS) codes that are not 100% composite materials.”

This includes a wide variety of products, including, but not limited to furniture, cork, and certain essential oils. The Lacey Act Partner Government Agency (PGA) message set will be expanded to support declaration requirements for products covered by Phase VII of the Enforcement Schedule as indicated in the FRN.

The following information will be required to submit a Lacey Act Declaration:

  • Scientific name (Genus and species)
  • Country of harvest
  • Quantity of the plant material in metric units of measure
  • Manufacturer Identification Code (MID)
  • Name/contact information of the Importer of Record (IOR) who is certifying the accuracy of the declaration
