Government of Canada Initiates Expiry Review of Seamless Carbon or Alloy Steel Oil & Gas Well Casing

On January 19, 2018, the Canadian International Trade Tribunal (CITT) gave notice that it had initiated an expiry review of its order made on March 11, 2013, to continue with an earlier finding concerning the dumping and subsidizing of seamless carbon or alloy steel oil and gas well casing from China.

As a result of the CITT’s expiry review, the Canada Border Services Agency (CBSA) initiated an expiry review investigation on January 22, 2018, to determine whether the expiry of the order is likely to result in the continuation or resumption of dumping and/or subsidizing of the subject goods. If the CBSA determines that the expiry of the order in respect of any goods is likely to result in the continuation or resumption of dumping and subsidizing, the CITT will then conduct an expiry review to determine if the continued or resumed dumping and subsidizing is likely to result in injury

CBSA will make a determination no later than June 21, 2018, and will issue a Statement of Reasons by July 6, 2018

The subject goods are described as seamless carbon or alloy steel oil and gas well casing, whether plain end, bevelled, threaded or threaded and coupled, heat-treated or non-heat-treated, meeting American Petroleum Institute (API) specification 5CT, with an outside diameter not exceeding 11.75 inches (298.5 mm), in all grades, including proprietary grades, originating in or exported from the People’s Republic of China.

These goods are normally imported under HS classification numbers 7304.29.00.11, 7304.29.00.19., 7304.29.00.21, and 7304.29.00.29.

As part of its expiry review investigation, the CBSA forwarded questionnaires to Canadian producers, importers, exporters and to the Government of China. Any Canadian producers, importers or exporters who have not received a letter from the CBSA who wish to provide a response to the questionnaire are advised to contact the officer identified below.

Responses to all questionnaires are due at the CBSA’s office in Ottawa by February 28, 2018.
