On August 19, 2016, the Canada Border Services Agency (CBSA) announced that it has launched an investigation under the Special Import Measures Act (SIMA) respecting the alleged injurious dumping of certain concrete reinforcing bar originating in or exported from the Republic of Belarus, Chinese Taipei, Hong Kong, Japan, the Portuguese Republic and the Kingdom of Spain.
The investigation follows a complaint filed by ArcelorMittal Long Products Canada, g.p. (Contrecoeur, QC), AltaSteel Ltd. (Edmonton, AB) and Gerdau Ameristeel Corporation (Whitby, Ontario).
Subject goods are described as hot-rolled deformed steel concrete reinforcing bar in straight lengths or coils, commonly identified as rebar, in various diameters up to and including 56.4 millimeters, in various finishes, excluding plain round bar and fabricated rebar products. Also excluded is 10 mm diameter (10M) rebar produced to meet the requirements of CSA G30 18.09 (or equivalent standards) that is coated to meet the requirements of epoxy standard ASTM A775/A 775M 04a (or equivalent standards) in lengths from 1 foot (30.48 cm) up to and including 8 feet (243.84 cm).
The goods in question are usually classified under Harmonized System classification numbers 7213.10.00.00, 7214.20.00.00, 7215.90.00.90, and 7227.90.00.90.
Concurrently on August 22, 2016 the Canadian International Trade Tribunal (CITT) gave notice that it has initiated an injury inquiry to determine if the alleged dumping of certain concrete reinforcing bar being investigated by CBSA, has caused injury or retardation or is threatening to cause injury to Canadian manufacturers.
Parties wishing to participate in the preliminary injury inquiry must file a notice of participation with the Tribunal on or before September 2, 2016.
