Environment Canada recently issued a notice advising importers, exporters and manufacturers of hydrofluorocarbons (HFC) that they are required to report by March 2, 2016 certain information for calendar years 2013 and 2014. The information that is required for reporting includes the year of reference, identifying information such as the name and quantities. The information will be used to assess if the substances are toxic or capable of becoming toxic and whether to control them.
The Canadian Environmental Protection Act, 1999 (CEPA 1999) section 71 notice with respect to Hydrofluorocarbons in bulk is published in Part I of the Canada Gazette.
If you imported, exported or manufactured more than 100 kg of a covered HFC, in bulk, whether alone or in a mixture, at a concentration equal to or above one percent by weight, you are required to comply with this requirement.
This requirement does not apply to HFCs that (a) are in transit through Canada, (b) are, or are contained in, a hazardous waste or hazardous recyclable material imported in 2013 or 2014 pursuant to a permit issued under the Export and Import of Hazardous Waste and Hazardous Recyclable Material Regulations, or (c) are contained in pre-charged equipment, consumer aerosols, foam products, fire suppression systems or fire extinguishing systems.
Responses to this notice shall be submitted to the Minister of the Environment, to the attention of the Substances Management Coordinator, Chemicals Management Plan, Gatineau, Quebec K1A 0H3.
