The United States Department of Agriculture’s (USDA) Animal and Plant Health Inspection Service (APHIS) will require a Lacey declaration for additional tariffs beginning October 1, 2021.
APHIS announced the updated enforcement date in the Federal Register on July 2, 2021. This Phase includes essential oils, trunks, cases, suitcases, wood packaging material, musical instructions, and monopods, bipods, and tripods.
The Lacey Act’s declaration requirement does not apply to packaging material used exclusively to support, protect, or carry another item, unless the packaging material itself is being imported. Furthermore, commodities classified under heading 4415 will only require a Lacey Act declaration if they are new and not being used in the transportation of goods.
