Government of Canada Initiates SIMA investigation on small power transformers

Canada Border Services Agency (CBSA) announced on April 15, 2021, that it has launched an investigation under the Special Import Measures Act (SIMA) respecting the alleged injurious dumping of certain small power transformers, originating or exported from Austria, Taiwan and Korea.

The investigation follows a complaint filed by Transformateurs Delta Star Inc., Northern Transformer Corporation, PTI Transformers Inc., and PTI Transformers L.P.                                

Subsequently, on April 16, 2021, the Canadian International Trade Tribunal (CITT) gave notice that it has initiated a preliminary injury inquiry to determine if the alleged dumping of certain small power transformers has caused injury or retardation or is threatening to cause injury to Canadian manufacturers. 

The subject goods, since 2019 are normally classified under HS codes 8504.22.00.20 & 8504.23.00.10.00. Incomplete small power transformers and parts and components thereof may also be classified under HS codes 8504.90.90.10, 8504.90.90.82 & 8504.90.90.90.

Parties wishing to participate in the preliminary injury inquiry must file a notice of participation with the CITT on or before April 28, 2021.
